Terms of Use
Last updated: 15 October 2026
These terms are the agreement between you and us for the FoodMate iPhone app and the services that come with it ("FoodMate"). By creating an account or using FoodMate, you agree to them. Our Privacy Policy explains how we handle your personal data. If you don’t agree, don’t use FoodMate.
1. Who we are
FoodMate is provided by Nikolai Langsem, a sole trader trading as Nlongvity ("we", "us"), Sinsenveien, 0572 Oslo, Norway. Contact: hello@nlongvity.com. In the app, Profile → Help → Contact FoodMate opens an email to this address.
2. Who can use FoodMate
- You must be at least 13 years old. By creating an account, you confirm that you are.
- If you are under the age at which you can agree to online services where you live, a parent or guardian must agree to these terms for you.
- If you are under 18, you need a parent or guardian’s permission to buy FoodMate Pro.
3. Your account
- You can create an account with your email address and a password, with Sign in with Apple, or with Google.
- Keep your sign-in details to yourself, and tell us at hello@nlongvity.com if you think someone else has used your account.
- You are responsible for what happens in your account.
- Your display name must not be offensive or misleading, and must not pretend to be someone else. Other members of your group battles see it.
4. What FoodMate does
FoodMate helps you decide where to eat.
- Battles. FoodMate puts 8 real restaurants near you, or in the city you chose, into a head-to-head bracket. Seven picks later you have a winner, and Directions opens it in Apple Maps.
- Group battles. You can host a battle and invite friends with a link. Everyone votes and the group sees the combined result. Other members see your display name and whether you have voted, not your individual picks.
- Hot Places. Rankings for each city, built from the wins and losses of restaurants across everyone’s battles.
- Palate. Taste matches worked out from the cuisines you chose and the picks you made. They are suggestions for you and decide nothing about you.
- Saved places. Restaurants you keep for later.
- Creator brackets. Brackets of 8 places published by creators we have approved, which anyone signed in can play (section 8).
5. Restaurant information
- Restaurant listings come from OpenStreetMap, a map made by volunteers (section 10).
- The food photos on restaurant cards are stock photos of the type of cuisine. They do not show that restaurant’s own food or premises. Photos in a creator’s bracket are added by that creator.
- A restaurant’s page may show a card from Google with photos, reviews and ratings. That card is Google’s content, loaded from Google; we do not check or edit it. When you use it, you are also bound by the Google Maps/Google Earth Additional Terms of Service and Google’s Privacy Policy.
- Restaurant information can be incomplete, wrong or out of date, including names, addresses, opening hours, cuisine and diet options. A place may have moved or closed. We don’t guarantee that it is accurate.
- A restaurant being listed, ranked or picked in FoodMate does not mean that it is connected with FoodMate or endorses it.
6. Allergen and diet warnings are guidance only
FoodMate can warn you when a restaurant may not suit the allergens and diets in your profile. These warnings are a guide, not a guarantee.
- Allergen warnings are based on the restaurant’s type of cuisine. They point out allergens that are common in that cuisine, not what a particular restaurant or dish contains.
- Diet information, such as vegetarian, vegan, halal or gluten-free options, comes from OpenStreetMap, where volunteers add it. It is often missing or out of date.
- Restaurants have not checked the warnings, and no dietitian or doctor has reviewed them. They are not medical or dietary advice.
- No warning does not mean that a place or dish is safe for you.
- Always confirm allergens and ingredients with the restaurant before you order.
7. FoodMate Pro
FoodMate is free to use, with limits. FoodMate Pro removes them.
- Free: 3 solo battles and 1 hosted group battle a day (counted per calendar day, Norwegian time), the distance and No chains filters, the top 10 of Hot Places, your top 3 Palate matches and 10 saved places.
- Always free: joining a friend’s group battle and playing a creator’s bracket. They never count against your limits.
- FoodMate Pro: unlimited solo battles, hosting group battles without a daily limit, the Open now, cuisine and diet filters, the full Hot Places ranking, every Palate match and unlimited saved places.
- We may change what the free version and Pro include. The current limits are shown in the app under Profile → Plan.
Subscription terms
- FoodMate Pro is a monthly auto-renewing subscription, bought through Apple’s In-App Purchase. Its price in your local currency is shown in the app and in the App Store before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase.
- The subscription renews automatically each month unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
- You can manage or cancel the subscription at any time in your iPhone’s Settings → Apple ID (your name at the top) → Subscriptions, or in FoodMate under Profile → Plan → Manage subscription. When you cancel, Pro stays active until the end of the period you have paid for.
- Deleting the FoodMate app or your FoodMate account does not cancel FoodMate Pro. Cancel the subscription with Apple first. If you have Pro, the app reminds you of this before you delete your account.
- If you bought Pro and it is missing, for example on a new iPhone, tap Restore purchases on the FoodMate Pro screen.
- Apple takes the payment and we never see your card details. We use RevenueCat to know whether your subscription is active.
- Refunds, and your right of withdrawal for App Store purchases, are handled by Apple under Apple’s terms; ask Apple for a refund at reportaproblem.apple.com. If the price changes, Apple tells you before the new price applies to you, as its rules require. Your mandatory consumer rights are not affected.
- We give approved creators FoodMate Pro free of charge. We set it up ourselves, not through Apple, so nothing is charged and nothing renews. We may end it, for example if we revoke creator approval.
8. Creator brackets
Creator brackets are the only part of FoodMate where users publish their own content for everyone to see.
Who can publish, and who sees it
- Any FoodMate user can apply under Profile → Creators → Become a creator, with a handle, a display name and, if you like, a short bio and an Instagram handle.
- We review every application by hand and approve creators at our discretion. Only approved creators can publish brackets and upload photos.
- A bracket has a title, a city, a short intro and 8 restaurants from FoodMate’s listings in that city. For each place you can add a note of up to 120 characters and one photo.
- Your published brackets, your creator profile (handle, display name, bio and Instagram handle) and the notes and photos in your brackets are visible to everyone who uses FoodMate, for example in Discover and on the cards of people who play your bracket. Anyone with a bracket’s share link can open it in the app. Photos are stored at public web addresses, so anyone who has a photo’s address can see it.
- You see how your brackets are played only as totals: plays, finishes, directions opened, saves and which places won. You never see who played.
- You can take a bracket down at any time in your creator studio. Its link then stops working and it no longer appears in Discover.
Your content and the licence you give us
You keep the rights to what you publish. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, resize and show your creator profile, brackets, notes and photos in FoodMate and through your share links, so that FoodMate users can see and play your brackets. The licence ends when you delete your account, which deletes your creator profile, your brackets and their notes and photos. Taking a bracket down, or our removing it, stops it being shown.
What you promise
- You took every photo you upload yourself, or you have the right to publish it in FoodMate and to give us the licence above.
- No person can be recognised in your photos unless that person has agreed to it. This includes restaurant staff and other guests.
- Your photos and notes are about the place and its food, and your notes are your honest opinion.
- If a restaurant paid you or gave you anything, such as a free meal, for including it in a bracket, you say so clearly in the bracket’s intro or in that place’s note, as marketing law requires.
- Your handle, display name and Instagram handle are your own and do not pretend to be someone else.
FoodMate resizes each photo on your phone and saves it as a new image, which removes location and other data stored inside the file. It does not remove what can be seen in the photo, so check for faces, number plates, addresses and other personal details before you publish.
What you must not publish
- anything illegal, or anything that encourages others to break the law;
- hateful, discriminatory, harassing, threatening or bullying content, including about restaurant owners or staff;
- sexual content or nudity;
- violent, graphic or disturbing content;
- false or defamatory claims about a restaurant or a person;
- other people’s personal information, such as phone numbers or home addresses;
- content you don’t have the rights to, such as photos taken from a restaurant’s website, from social media or from Google;
- spam, hidden advertising, or advertising for alcohol, tobacco or drugs;
- content that is not about food or the places in the bracket;
- content that impersonates someone or misleads people about who you are.
Zero tolerance, reports and blocks
We have zero tolerance for objectionable content and abusive users. Every creator is approved by hand before they can publish, and:
- Report. Any signed-in user can report a bracket from its page: tap Report or block, choose a reason (not about food, offensive or hateful, spam or an ad, wrong or closed place, or something else) and send it. Reports are private; the creator does not see them. You can also report a creator, or anything else in FoodMate, by email to hello@nlongvity.com.
- Block. On the same screen you can block the bracket’s creator. You then no longer see any of their brackets, and their share links no longer open for you. You can’t undo a block in the app yet, so a block lasts until you delete your account.
- Review. We review every report within 24 hours. We remove content that breaks these terms, and we may revoke a creator’s approval, so that they can no longer publish or upload photos, or close the account of anyone who publishes objectionable content or abuses other users.
9. Acceptable use
You agree not to:
- use FoodMate for anything unlawful, or to harass, threaten, impersonate or deceive anyone;
- manipulate battles, votes, Hot Places rankings or bracket statistics, for example with automated voting, scripts or several accounts;
- use an invite link to disrupt someone else’s group battle;
- scrape, copy in bulk, probe, reverse-engineer or overload FoodMate or the services behind it, or get around its limits, its paywall or another user’s block;
- use restaurant data from FoodMate in ways that the OpenStreetMap licence or Google’s terms do not allow.
We may remove content, limit features, or suspend or close accounts that break these rules.
10. Our rights and other people’s
- FoodMate, its name, design and software belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app under these terms.
- Restaurant data © OpenStreetMap contributors, available under the Open Database License (ODbL). The app shows “Data © OpenStreetMap contributors” where it uses this data, with a link to openstreetmap.org/copyright.
- The cuisine photos are stock photos used under the Unsplash License.
- Google’s place card and its content belong to Google and its licensors.
- Restaurant names belong to their owners. Creator content belongs to its creators (section 8).
- If you think content in FoodMate infringes your copyright or other rights, email hello@nlongvity.com with a link to or a description of the content, the work it infringes and your contact details. We remove infringing content and close the accounts of repeat infringers.
11. Apple
If you downloaded FoodMate from Apple’s App Store, your licence to use the app is also governed by Apple’s standard Licensed Application End User License Agreement. These terms add to it. We, not Apple, are responsible for FoodMate, its content, and its maintenance and support. Sign in with Apple, App Store purchases and Apple Maps are provided by Apple under Apple’s own terms.
12. Disclaimers and liability
- FoodMate is provided as it is and as available. We keep improving it and may change, suspend or remove features. We try to keep it running, but we can’t promise that it will always be available or free of errors.
- FoodMate helps you choose; the choice is yours. We are not responsible for the restaurants, their food or service, or what happens when you visit them.
- Creators are responsible for what they publish. We act on reports as described in section 8.
- As far as Norwegian law allows, we are not liable for indirect loss, such as lost profits or lost data, or for loss caused by relying on restaurant information, allergen or diet warnings, Google’s place card or creator content.
- Nothing in these terms limits liability that cannot be limited under mandatory Norwegian law, such as liability for personal injury, gross negligence or intent, and nothing in these terms limits your rights as a consumer under Norwegian consumer law.
13. Ending the agreement
- You can stop using FoodMate at any time. To end the agreement, delete your account in the app: Profile → Delete account, then confirm twice. How to delete your account explains what is deleted, what is kept and how to ask us by email instead.
- Deleting your account also deletes your creator profile and your brackets with their notes and photos, so your share links stop working.
- Deleting your account does not cancel FoodMate Pro (section 7).
- We may suspend or close your account, revoke creator approval or remove content if you seriously or repeatedly break these terms, if you publish objectionable content or abuse other users, or where the law requires it.
- Sections 10, 12 and 15 continue to apply after the agreement ends.
14. Changes to these terms
We may update these terms, for example when FoodMate changes or the law requires it. The date at the top shows the current version. If a change is important, we will tell you in the app or by email before it applies to you. If you don’t agree with a change, you can delete your account before it takes effect.
15. Governing law and disputes
Norwegian law applies to these terms. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. If we can’t resolve a dispute together, consumers in Norway can ask the Norwegian Consumer Council (Forbrukerrådet) for mediation. Otherwise, disputes go to the Norwegian courts, with Oslo District Court as the agreed venue, unless mandatory law gives you the right to use the courts where you live.
