Terms of Use
Last updated: October 8, 2026 · Effective date: At App Store launch
The short version
MAXIMIZE helps you plan training, sleep and recovery. It is not a doctor, the coach can be wrong, your data is yours, and you can leave at any time.
You must be 16 or over. Every feature of MAXIMIZE is free. MAXIMIZE Pro is an optional subscription that raises two limits — 150 coach messages a day instead of 5, and 20 research questions a week instead of 1. It has no free trial and renews automatically until you cancel it, and everything about payment — charging, renewing, refunding, cancelling — happens in your Apple account, not here. The coach's answers are written by an AI model, and each reply in the app is labelled as such.
If you are in an emergency, MAXIMIZE is not an emergency service and cannot call anyone for you. Call 113 in Norway, or your local emergency number.
This summary is here to be read. It does not replace the sections below, and where the two differ the sections below are what apply.
These Terms of Use (the "Terms") govern your access to and use of the MAXIMIZE mobile application (listed on the App Store as "Maximize Performance"), its content, and the account and coach services behind it (together, "MAXIMIZE", the "Service"). MAXIMIZE is provided by Nikolai Langsem (trading as Nlongvity), a sole proprietorship registered in Norway, based in Oslo. A sole proprietor is the contracting party in person; Nlongvity is a trading name, not a separate legal entity. "We", "us" and "our" mean that individual. On the App Store the seller is shown as the individual's legal name, for the same reason.
By creating a MAXIMIZE account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. They apply alongside Apple's own terms for the App Store, which govern your purchase.
1. What MAXIMIZE is — and is not
MAXIMIZE is a health and fitness app with an AI coach. It gives general information about training, sleep, nutrition, recovery and habits, builds a daily plan from your goals and your schedule, and lets you log workouts, check-ins and sleep.
MAXIMIZE is NOT:
- A medical device under EU Medical Devices Regulation 2017/745
- A diagnostic tool
- A replacement for medical advice, diagnosis, or treatment
- A telemedicine service
- An emergency service
MAXIMIZE does NOT:
- Diagnose any condition
- Prescribe medication or supplements
- Provide individualized medical advice
- Replace consultation with a doctor, physiotherapist, dietitian or other qualified professional
Talk to a professional before starting or changing an exercise or nutrition programme, especially if you are pregnant, have an injury, a heart condition, an eating disorder, or any other condition that exercise or diet could affect. Stop and seek help if you feel pain, dizziness, chest discomfort or shortness of breath.
If you are experiencing a medical emergency, call your local emergency number immediately (113 in Norway). The coach is not designed to handle emergencies and may tell you to seek help instead of answering.
2. Eligibility
To use MAXIMIZE, you must:
- Be at least 16 years old — onboarding asks for your birth year and does not continue if you are younger
- Have the legal capacity to enter into a binding contract under Norwegian law, or the consent of a parent or guardian
- Provide accurate information during onboarding
- Not be barred from using the Service under any applicable law
3. Your account
You can use MAXIMIZE without an account; your data then stays only on your phone. An account (Sign in with Apple, Sign in with Google or a one-time email code) lets you sync across devices and use the coach.
You are responsible for:
- Keeping your sign-in method secure
- All activities under your account
- Notifying us immediately at hello@nlongvity.com if you think someone else is using your account
You can delete your account at any time in Settings → Privacy & Security. Deletion removes your data from our servers and, where possible, revokes the Sign in with Apple grant with Apple. See Delete your account.
We may suspend or terminate accounts that violate these Terms, applicable law, or Apple's App Store policies.
4. Subscription and payments
MAXIMIZE has a free tier and an optional paid subscription.
Free tier: Every feature is available without payment — the daily plan with morning and evening routines and a suggestion for what to do right now, programmes, workout logging and progress history, protein and nutrition targets, sleep and recovery tracking, Apple Health and calendar connections, 5 coach messages a day and 1 research question a week, and full privacy controls, export and deletion.Security, export and deletion are never paid features.
Paid subscriptions: MAXIMIZE Pro raises two limits that our servers enforce: 150 coach messages a day instead of 5, and 20 research questions a week instead of 1. It unlocks no other features; everything else in the app is the same with or without Pro. Pro is offered as a monthly and an annual subscription. The price, the period and what Pro includes are displayed in the app before you buy.
Billing: MAXIMIZE is currently available on iOS only, and all subscriptions are sold and billed through the Apple App Store, where Apple is the seller of record. Payment is charged to your Apple ID. Billing terms, refund policies, price changes and renewal mechanics are governed by Apple. We never see your payment details and we cannot charge, refund or cancel anything ourselves. When you buy, your MAXIMIZE account identifier is attached to the purchase so that Apple's record of the subscription can be matched to your account and Pro unlocked on every device you sign in on.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple ID settings, not in the app.
No free trial: MAXIMIZE Pro does not offer a free trial. You are charged when you confirm the purchase with Apple.
Price changes: We may change Pro's price or what it includes. Changes to price apply only from the next renewal. Apple notifies subscribers of price increases and, where required, asks for consent before the new price takes effect. That process is Apple's, not ours.
Right of withdrawal (angrerett): Norwegian and EU consumer law gives you a 14-day right of withdrawal for distance contracts (angrerettloven). Because Apple is the seller of App Store subscriptions, that right is exercised with Apple, under Apple's Media Services terms, at reportaproblem.apple.com. Nothing in these Terms asks you to waive it.
Refunds: Refund requests are made to Apple at reportaproblem.apple.com and decided by Apple under its policies. We cannot issue refunds for App Store subscriptions ourselves.
5. Health data and your responsibility
By using MAXIMIZE, you acknowledge:
- MAXIMIZE processes special category health data under Article 9 GDPR based on your explicit consent, which you give during setup and may withdraw at any time
- The information MAXIMIZE shows you (plans, recovery bands, recommendations, coach replies, evidence summaries) is informational only
- You are responsible for any decisions you make based on MAXIMIZE's output
- You should not rely on MAXIMIZE for medical decisions; always consult a qualified professional
- MAXIMIZE's plans and recommendations are based on patterns in your own data and are not guaranteed accurate or suitable for you
- MAXIMIZE does not detect, diagnose, or treat any medical condition
- If you experience pain, new symptoms, or red-flag symptoms, seek medical care rather than logging them in MAXIMIZE
6. The AI coach and AI-generated content
The coach is an automated assistant built on a third-party language model (currently Anthropic Claude). Its answers are generated from your question, the last eight turns of the thread, and a small, allow-listed set of your app data — goals, mode, constraints you have told us about, today's plan, check-ins, recent training — described in full in the Privacy Policy. The coach and research answer only after you allow AI answers in the app, and you can turn that off in Settings → Privacy & Security without losing the rest of the Service. By using the Service:
- You acknowledge that the coach's answers can be wrong, incomplete or out of date, and may not match your situation
- You are solely responsible for your decisions and actions, regardless of what the coach tells you
- We make no warranty of accuracy, fitness for purpose, or non-infringement of generated content
- The coach's output is informational only and is not medical advice; check anything that matters with a professional
Coach messages are limited per day and research questions per week: 5 and 1 on the free tier, 150 and 20 with MAXIMIZE Pro. The MAXIMIZE Pro screen in the app lists the current limits. We may change them; a change that reduces what Pro includes follows section 10.
In compliance with EU AI Act Article 50, we disclose that coach replies and evidence summaries are generated by an AI model, not by a person. In the app, each coach reply carries an AI label.
Content ownership: You retain ownership of all content you create in MAXIMIZE — your logs, your entries, your messages. You grant us a limited, non-exclusive licence to store and process this content within the Service only to run it for you. We do not use your content to train AI models, and under our agreement with Anthropic they may not either.
Evidence summaries cite third-party research. We do not own those papers, and a summary is not a substitute for reading them.
7. Apple Health and calendar
If you allow it, MAXIMIZE reads data from Apple Health (read-only) and your device calendar to tailor your plan. You control these permissions in iOS Settings. Calendar contents never leave your phone. Health data leaves your phone only as daily summaries, and sleep and weight entries derived from them, and only if you turn on health sync.
We are not responsible for data recorded by other apps or devices that Apple Health passes on to us.
8. Acceptable use
You may not use MAXIMIZE to:
- Violate any law of Norway, the EU, or any applicable jurisdiction
- Harm yourself or others
- Infringe intellectual property rights
- Impersonate another person
- Reverse-engineer, decompile, attack, or attempt to derive source code of the Service
- Try to get the coach to produce content that violates these Terms
- Build a competing product using MAXIMIZE's outputs
- Scrape or abuse the Service or its third-party APIs
- Use bots, scripts, or automated tools to manipulate the Service
- Resell access to the Service without our written agreement
Violations may result in immediate account suspension or termination without refund.
9. Content and intellectual property
The app, its programmes, guides, text and design belong to us or our licensors. You get a personal, non-transferable licence to use them through the app. Your own data stays yours (see section 6).
If you got MAXIMIZE from the App Store, Apple’s standard Licensed Application End User License Agreement also applies to the app. These Terms add to it; where the two differ on the licence to use the app, Apple’s agreement applies.
10. Service availability
We work to keep the Service available but do not promise it will be uninterrupted or error-free. The Service is provided "as is" and "as available." MAXIMIZE is under active development: features may be added, changed or removed, and we may modify, suspend or discontinue features, or do so immediately if required by law or security concerns.
If we remove something material that a paid subscription was bought for, we will give reasonable notice in the app, and you may cancel before the next renewal.
We do not guarantee that MAXIMIZE will be available during a medical emergency. Do not rely on MAXIMIZE in emergencies — contact emergency services directly (113 in Norway).
11. Third-party services
MAXIMIZE integrates with third-party services including the Apple App Store, RevenueCat (purchase validation), Apple HealthKit, Sign in with Apple, Sign in with Google, Anthropic, Resend (sign-in emails), Sentry (crash reports, where enabled), and the public research databases PubMed and Semantic Scholar. Their respective terms apply when using those features. We are not responsible for third-party service availability, accuracy, or actions. The Privacy Policy lists every processor and what each one receives.
12. Limitation of liability
To the maximum extent permitted by Norwegian law:
- The Service is provided without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except where mandatory consumer protection law (forbrukerkjøpsloven, angrerettloven) provides otherwise
- We are not liable for indirect, incidental, consequential, or special damages
- We are not liable for lost profits, lost data, lost goodwill, or business interruption
- We are not liable for any injury, health outcome, or harm arising from your use of MAXIMIZE, your reliance on its plans, recommendations or coach replies, your delay in seeking medical care, or any AI-generated content
- We are not liable for damages caused by third-party services (Apple, Anthropic, and the others listed in the Privacy Policy)
- If you use MAXIMIZE without an account, your data exists only on your own device, and we cannot be responsible for it when a device is lost, reset, or when the app is deleted
- Our total cumulative liability for any claim arising from these Terms or the Service is limited to the amount you paid for MAXIMIZE in the 12 months preceding the event giving rise to the claim, or NOK 500, whichever is greater
These limitations do not exclude liability for gross negligence, willful misconduct, personal injury, death, or any liability that cannot be limited under mandatory Norwegian consumer law. Your mandatory rights as a consumer under Norwegian and EEA law apply in full and are not waived by anything here. If you are a consumer in the EU or EEA, the mandatory consumer protection rules of your country of residence apply in addition to these Terms.
13. Indemnification
You agree to defend and indemnify us against claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Decisions you make based on MAXIMIZE's output, including delaying or forgoing medical care
- Your violation of third-party rights or applicable law
This indemnification does not apply to claims caused by our gross negligence or willful misconduct.
14. Termination
By you: You may stop using MAXIMIZE and delete your account at any time via Settings → Privacy & Security → Delete my account and data, or by emailing privacy@nlongvity.com. See Delete your account. You may also cancel a subscription at any time through your Apple account; cancelling a subscription is something only you or Apple can do.
By us: We may terminate or suspend your access immediately, without prior notice, if:
- You materially breach these Terms
- We are required to do so by law or court order
- Continuing the Service to you would expose us to legal risk
If we do, we will say why, unless we are legally prevented from doing so, and where possible let you export your data first.
Upon termination, your right to use the Service ends. Personal data is deleted per our Privacy Policy. Data that exists only on your device remains under your control.
Sections that by their nature survive termination (limitation of liability, indemnification, governing law) survive.
15. Changes to these Terms
We may update these Terms. For material changes we will tell you in the app at least 30 days before they take effect, and the date at the top of this page will change. Continued use after the effective date constitutes acceptance.
If you do not agree with material changes, your remedy is to terminate your account before the effective date.
16. Governing law and dispute resolution
These Terms are governed by Norwegian law, without regard to conflict-of-law principles.
Disputes shall first be attempted resolved amicably by contacting hello@nlongvity.com.
If amicable resolution fails:
- For consumers: disputes may be brought in the consumer's home jurisdiction within the EEA, or in Norway. Norwegian consumers retain mandatory rights under Norwegian consumer protection law that cannot be waived.
- For business users: disputes shall be subject to the exclusive jurisdiction of the Norwegian courts
Nothing in these Terms prevents a consumer from invoking mandatory consumer protections in their country of residence.
Norwegian consumers may also bring a complaint to the Consumer Council (Forbrukerrådet) or the Consumer Complaints Board (Forbrukerklageutvalget).
17. Norwegian Consumer Authority
Information about Norwegian consumer rights is available from:
Forbrukertilsynet (Norwegian Consumer Authority)
www.forbrukertilsynet.no
18. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, along with the Privacy Policy and any in-app notices, constitute the entire agreement between you and us regarding the Service.
